The reproduction or representation of images, texts or documents without authorization is punishable under civil law by an award of damages. These damages are determined on a case-by-case basis. It depends on the victim’s loss of profit, the damage suffered as a result of the misrepresentation of the site’s presentation and the impact this may have had on the author of the site. It also depends on how the image was promoted and what it may have brought to the designer in financial terms.
